Terms of Service

Welcome to Outmap. These Terms of Service ("Terms") are a binding legal contract between you and Outmap Technology Ltd. ("Outmap," "we," "us," or "our"). By creating an account, accessing our mobile applications, or using our website at https://outmap.pro (collectively, the "Services"), you agree to these Terms. If you do not agree, do not use Outmap.

1. Corporate Identity and Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Vancouver, British Columbia.

2. Assumption of Risk and Safety Disclaimer

Read this carefully. Outmap is a navigation tool, not a safety guarantee.

Outmap provides maps, route data, and backcountry tools, but we do not control, monitor, or maintain the physical environment. Terrain conditions change, weather shifts rapidly, avalanches happen, and digital GPS data or map layers can be inaccurate, delayed, or incomplete.

By using Outmap, you acknowledge that outdoor activities—including but not limited to backcountry freeride skiing, mountaineering, rock climbing, and mountain biking—carry inherent risks of severe injury, property damage, or death. Users remain entirely responsible for their own field decisions, safety, and real-world navigation.

‍3. Emergency and Lifeline Disclaimer

Outmap is not a life-safety device or an emergency service infrastructure. The Services must never be used as a primary or sole lifesaver in critical, survival, or emergency situations. The app requires battery power, device functionality, and satellite/cellular data availability to operate, all of which can fail. Always carry secondary, analog navigation equipment (such as a physical map and compass), monitor local avalanche and weather forecasts, and travel with appropriate emergency rescue gear.

4. Third-Party Guides and Information Marketplace

Outmap acts as a technology platform and information directory, not a guiding company, outfitter, or travel agency. We may display information about, or provide access to, independent third-party professional guides, tours, or outdoor services.

We do not employ, supervise, or legally endorse these third parties. If you choose to hire or follow an independent guide or service provider found through Outmap, the contract is strictly between you and that provider. To the fullest extent permitted by law, Outmap assumes no liability for the acts, omissions, negligence, or failures of any third-party guide or outdoor service provider. The guiding party is solely responsible for your physical safety and legal compliance during their operations.

5. Third-Party Map Data and Base Layers

Certain map layers, public land boundaries, and data sets provided through the Services are sourced from third-party public and private entities (including government land registries and open-source mapping projects). Outmap does not verify the absolute accuracy of third-party data feeds. To the fullest extent permitted by law, Outmap disclaims any responsibility or liability for errors, omissions, or inaccuracies in third-party base maps or geospatial layers.

6. User Content and Splitting of Licenses

Outmap allows you to log private tracks, save personal waypoints, upload photos, and publish public Guidebooks ("User Content"). You retain your underlying copyright to any original content you submit to the platform. However, our rights to use that content depend on how you set your privacy boundaries:

Private User Content: For content you keep private or unshared, you grant Outmap a limited, worldwide, royalty-free, and non-exclusive license to host, store, transfer, and reproduce your content solely for the purpose of displaying it to you and operating the Services on your behalf.

Public User Content: If you choose to publish a Guidebook, public route, public photo, review, or comment, you grant Outmap a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, distribute, and commercialize that content in any format or medium, including the training of machine learning and artificial intelligence models.

7. Content Retention and Deletion Compliance

Your right to delete User Content is subject to applicable privacy laws (such as GDPR and CCPA/CPRA) and the structural rules of the Outmap ecosystem:

Private Data Deletion: Upon account deletion or valid erasure request, your private Personal Information and private User Content will be purged from our active databases.

Public Content Framework: If you have chosen to publish public content (e.g., public Guidebooks or community trail photos), this data becomes part of the shared Outmap public database. To protect the integrity of the mapping network for other users, we retain this public structural data. Upon an erasure request, we will satisfy privacy laws by permanently stripping your name, profile photo, and personal account identifiers from the public content, reattributing the asset to the "Outmap Community."

8. Subscriptions, Payments, and Refunding Channels

Outmap offers premium navigation features through paid subscriptions.

Billing and Auto-Renewal: Subscriptions are billed in advance on a recurring basis (monthly or annually) and automatically renew until cancelled.

App Store Transactions (Apple & Google): For subscriptions purchased via the Apple App Store or Google Play Store, all payments, cancellations, and refund requests are handled entirely through those native platforms. Outmap has no mechanical capability to issue refunds for App Store transactions; refunds are subject strictly to Apple and Google’s respective platform terms.

Web Transactions (Stripe): For subscriptions purchased directly via the Outmap website, processing is handled by Stripe. You can manage billing and cancellations through your Outmap account dashboard. Unless explicitly required by applicable local law, all web-processed subscription fees are non-refundable.

9. Acceptable Use and Platform Integrity

You agree that you will not:

Scrape, crawl, or systematically extract map tiles, vector data, or user coordinates from Outmap for use in competing applications or databases.

Reverse engineer, decompile, or attempt to extract the source code or proprietary algorithms of the Services.

Post intentionally fraudulent or dangerously misleading geospatial data.

Use the platform to facilitate illegal activities, trespass on private property, or enter legally restricted wildlife boundaries.

Violation of these terms will result in immediate termination of account access without warning.

10. Copyright Takedown (DMCA and Intellectual Property Protection)

Outmap respects intellectual property rights. If you believe that any content hosted on our platform infringes your copyright, please submit a formal takedown notice to our designated agent at legal@outmap.pro containing: a description of the copyrighted work, the specific URL/location of the infringing material on Outmap, and your contact information.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Outmap, its affiliates, directors, officers, employees, and shareholders shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, revenue, or goodwill, arising out of or related to your use of the Services.

12. Terms Modifications

We reserve the right to modify these Terms. Material changes will be communicated via our application interface using a mandatory clickwrap acceptance modal. Your explicit acceptance of the updated terms through this modal is required to maintain access to premium features and active account navigation
